This website is operated by Parlor Wines LLC, DBA Parlor Wines. Throughout this site, the terms “we”, “us,” and/or “our” refer to Parlor Wines. Parlor Wines offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

You agree to submit to the jurisdiction of the courts located in Washington, D.C. for the resolution of all disputes arising from or related to these Terms of Service and/or your use of the website.


AUTHORIZED USE; PROHIBITIONS

Certain Parlor Wines content provided through our site is protected by intellectual property laws, including but not limited to copyright, trademark, and trade dress laws. For example, the content on our site is protected by copyright as a collective work or compilation (meaning the collection, arrangement, and assembly) under U.S. and international copyright and other laws and is the property of Parlor Wines, its licensors, or the party credited as the provider of the content. All Parlor Wines graphics, logos and service names are trademarks of Parlor Wines, and may not be used in connection with any product or service except with the written permission of Parlor Wines and may not be used in any manner that is likely to cause confusion among the public, or in any manner that disparages or discredits Parlor Wines, or its products or services. You acknowledge and agree that the content accessible through this site that is not expressly designated as being provided by a third party is the property of Parlor Wines and its content providers, and that Parlor Wines and its content providers retain all right, title, and interest in the content.

 

This website contains material that is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms of Service. All trademarks reproduced in this website that are not the property of, or licensed to, the operator are acknowledged on the site.

Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense. From time to time, this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

 

SECTION 2 - ONLINE STORE TERMS

 

ACCESS TO THE SITE AND OUR ONLINE STORE:

We do not sell alcohol to persons under the age of 21.  By using this site, you affirm and acknowledge that you are over the age of 21, that the person placing the order and receiving a shipment of alcoholic beverages from us is over the age of 21 and that receipt of shipments containing alcoholic beverages requires the signature of a person 21 years of age or older. You also agree that any alcohol purchased from us is intended for personal consumption and not for resale. If you do not agree with these conditions of use, please do not use this site.

As a condition to accessing this site, you may be required to register with Parlor Wines.  You shall provide Parlor Wines with accurate, complete, and updated information. Failure to do so shall constitute a breach of these Terms of Service, which may result in immediate termination of your account. We reserve the right to refuse registration or cancel your account for any reason or no reason at all.

If you wish to purchase any product or service listed on this site, you may be asked to supply certain information relevant to the purchase including, without limitation, your credit card information, your billing address and your shipping information. You represent and warrant that you have the legal right and authority to use any credit card, debit card, gift card, gift certificate or coupon code utilized in connection with any transaction on this site.

 

SALES:

 

ALL SALES ARE FINAL.  We are a family-run business and we are unable to offer refunds or returns on purchases.

Each product and/or service listed on this site is sold by Parlor Wines, a licensed alcoholic beverage retailer. In all instances, any solicitation, invitation, offer, advertisement or communication is void where prohibited by applicable law.  Title to and ownership of wines purchased from our site pass from Parlor Wines to the buyer in the District of Columbia (Washington DC). Parlor Wines does not convey or intimate the right of any person to transport beverage alcohol across any state border. The buyer takes all responsibility for the shipping of his or her wine from Washington DC to his or her home state. Sales tax will be applied based on the seller’s location. 

 

CREDIT CARD CHARGES -- GENERAL

Orders are by credit card only. We accept Visa, MasterCard, Discover and American Express. The billing address for any such credit card needs to be provided at the time of your order and must be the address on your credit card statement.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

 

CREDIT CARD CHARGES – QUARTERLY WINE CLUB

In addition to agreeing to the terms presented in CREDIT CARD CHARGES – GENERAL, you agree that by becoming a member of our Quarterly Wine Club, you authorize Parlor Wines to charge your credit card (including shipping and any applicable tax) for the TOTAL ANNUAL SUBSCRIPTION fee for the Quarterly Wine Club option or options you have selected.  You are responsible for providing up-to-date credit card information before orders are processed. You may cancel your Quarterly Wine Club subscription for any orders not yet shipped up to 45 days prior to shipment.

Any offer for any product or service made on this site is void where prohibited.

SECTION 3 – DELIVERY AND SHIPPING

​

ADULT SIGNATURE REQURED

An adult 21 years of age or older must sign for the wine at the time of delivery.  We cannot deliver wine without the signature of an adult 21 years of age or older.

​

SHIPPING CONDITIONS

During times of inclement weather, either extreme heat or extreme cold, Parlor Wines reserves the right to delay shipments to affected areas until conditions improve. Please be advised that Parlor Wines is not responsible for items damaged due to extreme weather conditions.


SHIPPING AND DELIVERY DONE AT YOUR REQUEST

By placing an order, the buyer authorizes Parlor Wines to act on buyer’s behalf in arranging for transportation of wine at the buyer’s direction. Parlor Wines will arrange for shipment on behalf of the buyer, to an address specified by the buyer. The buyer represents that they are acting in a manner compliant with their state and local laws regarding the purchase, transport and delivery of wine. The buyer represents that they obtained any required permission, paid any required fees, is legally entitled to take possession of wine, is legally entitled to take quantities ordered, and certifies that he or she is at least 21 years of age. Parlor Wines assumes no liability for breach of any regulation by the purchaser. 


Parlor Wines requires customers to have their purchases delivered to themselves under such legal rights as may exist (and such rights change regularly – consumers are advised to know the requirements that apply to them) for them to take delivery of wine in the state or area in which they live. This legally permitted method of doing business involves the following steps (1) title legally transfers in the state of sale, where the goods are sold, (2) Parlor Wines files tax reports in accordance with District of Columbia law, and (3) the bill of lading shows the customer (who directs the process of having his or her wine or goods delivered in accordance with the customer’s legal rights) as the party directing the delivery.

 

 

SECTION 4 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION 

 

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. 

 

 

SECTION 5 - MODIFICATIONS TO THE SERVICE AND PRICES

 

Prices and availability on all products and services are subject to change without notice.  Parlor Wines reserves the right to limit quantities while supplies last.  Due to variations in condition and sourcing, the same product may occasionally be listed with different prices.  

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. 

We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. 

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

 

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION 

 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made on our online store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. 

 

 

SECTION 7 - OPTIONAL TOOLS

 

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. 

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. From time to time, Parlor Wines may refer you to physical venues, geographical sites, websites on the Internet, and/or products or services that are owned, under the control of, or maintained by a third party (“Third-Party Properties”). Unless expressly stated to the contrary, such references do not constitute an affiliation with or endorsement by Parlor Wines of any such Third-Party Properties. You acknowledge that Parlor Wines is providing any references to such Third-Party Properties to you solely as a convenience to you, and you agree that Parlor Wines is not responsible for any injury, harm, damages, or negative experience you may encounter by accessing, visiting, or using such Third-Party Properties. Parlor wines does not endorse or make any representations about any Third-Party Properties. If you access, visit, or use any Third-Party Properties referred to through this site, you do so at your own risk.

 

Please drink responsibly.  Parlor Wines highly recommends the use of designated driver transportation to and from events, either by taxi, limo, Uber, group shuttle or private car service.

 

SECTION 10 - USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

 

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

 

We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. Parlor Wines will not sell or provide your information to any other party. Any information which we gather is solely necessary for the course of normal business operations and processing orders.


We will occasionally send notices and emails about changes, specials, new items, or events (“Promotional Emails”).  You always have the option to opt out of receiving Promotional Emails from Parlor Wines.

 

By using the Site, you represent that you are qualified and authorized to use this Site under the account registered. You acknowledge that you are responsible for maintaining the accuracy, confidentiality, and privacy of your account information. You agree to be solely responsible and liable for any and all activities that occur under your account. If you become aware of any unauthorized use of account information, you agree to notify us immediately at barryandisa@parlorwines.com.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PARLOR WINES OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. IF YOU ARE DISSATISFIED WITH THE SITE, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SITE.

 

b. ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE USE OF THE SITE IS AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE THAT RESULTS.

 

c. LIMITATION OF LIABILITY. IN NO EVENT SHALL PARLOR WINES OR ANY OF ITS EMPLOYEES, AGENTS, AFFILIATES, OR CONTENT OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR INABILITY TO USE, THE SITE AND/OR ITEMS RELATED THERETO OR UNDER ANY THEORY OF LIABILITY WHATSOEVER EVEN IF SOMMPICKS OR SUCH INDIVIDUAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

 

 

SECTION 15 – INDEMNIFICATION 

 

You agree to indemnify, defend, and hold harmless Parlor Wines, its owners, employees, agents and affiliates from and against all losses, expenses, damages, and costs (including reasonable attorneys’ fees and costs), resulting from any violation of these Terms and Conditions by you. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will fully cooperate with us in asserting any available defenses.

 

 

SECTION 16 – SEVERABILITY

 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
